Anito é mais conhecido por ser um dos acusadores de Sócrates, mas este político teve outra proeza: sua sagacidade o fez criar um método obscuro de identificar os jurados e assim saber exatamente a quem subornar em um processo legal, ou seja, ele conseguia identificar quem eram os dikastaí que estariam agrupados no dikastḗrion específico que julgaria determinado caso em um tribunal. Com essa metodologia ele conseguiu se safar de uma condenação em 409 a.e.c., quando por sua falha Atenas (...) perdeu Pilos (Aristóteles, Constituição de Atenas, 27.5). A façanha desse cidadão possivelmente foi a origem de dois novos verbos (dekázein e syndekázein) e o motivo de uma nova lei contra esse método (reportada no segundo Contra Estéfano de Demóstenes, 46.26). Além disso, duas décadas depois, o sistema por sorteio para a escolha de jurados foi totalmente reformulado, justamente para evitar esse esquema corrupto que ele empregou. Este artigo fará a exposição desses aspectos legais relacionados à escolha de jurados no século V, bem como abordará a corrupção e suborno que foi feita a partir desse método de Anito, discorrendo também sobre uma alteração proposta no século IV (que aparece na Assembleia das Mulheres de Aristófanes) e a terceira reformulação, apresentada em Aristóteles, Constituição de Atenas, 63-66. Também se explorará essa temática com a Apologia de Platão, uma vez que Anito, aquele que subornou jurados, é o mesmo agente que está processando Sócrates por corromper (diaphtheírein) os jovens, aproveitando-se assim a ambiguidade deste verbo, pois pode significar tanto a corrupção moral em sentido largo, como também aquela motivada por suborno. Aberrant consumer behaviour costs firms millions of pounds a year, and the Internet has provided young techno-literate consumers with a new medium to exploit businesses. This paper addresses Internet related ethics and describes the ways in which young consumers misdemean on the Internet and their attitudes towards these. Using a sample of 219 generation Y consumers, the study identified 24 aberrant behaviours which grouped into five factors; illegal, questionable activities, hacking related, human Internet trade and downloading. Those perceived as least (...) wrong were; "Downloading movie and music files from the Internet for free". The consequences of these behaviours have implications for educators, consumer policy and marketers. (shrink)

G. A. Cohen has argued that there is a surprising truth in conservatism—namely, that there is a reason for some valuable things to be preserved, even if they could be replaced with other, more valuable things. This conservative thesis is motivated, Cohen suggests, by our judgments about a range of hypothetical cases. After reconstructing Cohen's conservative thesis, I argue that the relevant judgments about these cases do not favor the conservative thesis over standard, nonconservative axiological views. But I then argue (...) that there is a Mirrored Histories case that is such that, if one shares Cohen's conservative attitude, judgments about this case favor Cohen's conservative thesis over a wide range of non-conservative axiological views. Reflection on this case also suggests a different explanation of apparently conservative judgments that merits consideration in its own right. (shrink)

Drawing on Catherine Malabou’s notion of plasticity, this article argues for a conception of resilience as plastic. Resilience has proven an important concept in health care, describing how we manage life-changing illnesses. Yet, resilience is not without its critics, who suggest it neglects a political, social, or personal dimension in illness. In this article, I propose that a concept of plastic resilience can address these criticisms. On this account, success should not be based on a return to function, but rather (...) on how actively we are involved in the formation of a new self after illness. I address some approaches that can benefit from “plastic resilience,” namely, art therapy, expert companionship, and shared decision-making. In each case, I underline how we should help patients thematize and engage with their new selves, while also being constantly vigilant for how these changes might impact our current assumptions around their preferences for treatment. Knowledge aims to fit the world, and action to change it. In this collection of essays, Onora O'Neill explores the relationship between these concepts and shows that principles are not enough for ethical thought or action: we also need to understand how practical judgement identifies ways of enacting them and of changing the way things are. Both ethical and technical judgement are supported, she contends, by bringing to bear multiple considerations, ranging from ethical principles to real-world constraints, and while we (...) will never find practical algorithms - let alone ethical algorithms - that resolve moral and political issues, good practical judgement can bring abstract principles to bear in situations that call for action. Her essays thus challenge claims that all inquiry must use either the empirical methods of scientific inquiry or the interpretive methods of the humanities. Although the idea of the public interest features prominently in many accounts of deliberative democracy, the relationship between deliberative democracy and the public interest is rarely spelt out with any degree of precision. In this article, I identify and defend one particular way of framing this relationship. I begin by arguing that people can deliberate about the public interest only if the public interest is, in principle, identifiable independently of their deliberations. Of course, some pluralists claim that the public interest (...) is an implausible idea, which casts doubt on the idea that there might be something for people to deliberate about. Yet while, following Brian Barry, we can get around this problem by defining the public interest as an interest in which everyone shares qua member of the public, what still needs to be explained is why people should be prepared to privilege this particular capacity. I argue that the account of political equality with which deliberative democracy is bound up offers a compelling explanation of this sort, even if it also gives rise to some difficult questions of feasibility. I conclude by considering the charge that any political scheme that framed the relationship between deliberative democracy and the public interest in this way would be undesirable. (shrink)

For the Enlightenment, science represented an ideal of rational argument, behaviour and community against which could be judged the arbitrary power and authority of other spheres of human practice. This Enlightenment ideal runs through much liberal and socialist theory. However, the Enlightenment picture of science has appeared to many to be increasingly uncompelling. What explains the apparent decline of the Enlightenment vision? This book explores one neglected answer originally proposed by Husserl, that its decline is rooted in formalism, in the (...) view that all there is to theoretical science is the construction and mastery of formal systems. O'Neill demonstrates formalist accounts of mathematics and natural science to be inadequate, and then considers and rejects Husserl's views on the origin of the formalization of the sciences. The book concludes by arguing that the rise of a formalist view of the sciences is founded in the professionalization of modern science, and discusses the significance of this professionalization for the fate of the Enlightenment view of science. Worlds Without Content: Against Formalism tackles an important set of issues which have been neglected in recent philosophy of science, and in so doing highlights themes in Husserl's later works which have been ignored by most commentators. It will be of particular interest for philosophers of mathematics, science and social theory, and for historians of mathematics and philosophy. (shrink)

The grammarian Caesellius Vindex, writing under Trajan, criticized Furius Antias for his newly coined verbs lutescere, noctescere, opulescere and vīrescere. Their meanings in classical Latin are classified by Nicolaie as follows: becoming, the intensification of a quality, the acquisition of a quality. Their number increases in post-classical Latin, in which we also find them used causatively as transitive verbs, e.g. innotescere ‘make known’; Gellius' causative use of inolesco is mentioned below. Incohative verbs descend to Romance languages, where forms in -o (...) and in -sco both contribute to some conjugations, e.g. Fr. finir, finissant; It. finire, finisco, and to English. (shrink)

Ground, essence, and modality seem to have something to do with each other. Can we provide unified foundations for ground and essence, or should we treat each as primitives? Can modality be grounded in essence, or should essence be expressed in terms of modality? Does grounding entail necessitation? Are the notions of ground and essence univocal? This volume focuses on the links—or lack thereof—between these three notions, as well as the foundations of ground, essence, and modality more generally, bringing together (...) work on the metaphysics, epistemology, and logic of these three notions by some of the leading figures in the field as well as emerging young scholars. The invited contributors to this volume presented their work at a conference on Ground, Essence, and Modality at the University of Helsinki in June 2016, funded by the Academy of Finland Project The Epistemology of Metaphysics: From Rationalism to Nominalism. This conference is just one of many recent high-profile events and publications on these themes (e.g., the edited volumes Correia and Schnieder 2012a; Sirkel and Tahko 2014; Jago 2016). After providing a brief historical summary of the (re)emergence of modality, essence and ground as central notions in metaphysics (Sect. 1), we shall outline some of the main themes in recent work on these notions and on the links between them (Sect. 2). An analysis of how Adorno's "pure" philosophy can be seen to provide a justification of the rationality required by critical theory.

This article argues that Jacques Derrida’s Politics of Friendship presents an implicit but significant critique of Maurice Blanchot’s The Unavowable Community. In Blanchot’s text, the Other disrupts any sense of fusional or essentialist community. But Derrida criticises Blanchot for neglecting the need to negotiate my responsibility to infinite others. Derrida proposes a logic of the plus un, playing on this double meaning in French, where a need to count singularities (‘plus one’) disrupts the unity of community (‘no longer one’). For (...) Derrida, this offers a greater emphasis on those outside the boundaries of constituted communities, something he finds lacking in Blanchot. I demonstrate that Derrida’s position is a challenge to an emerging xenophobic discourse in 1980s French politics. I propose, therefore, that Derrida’s difference with Blanchot is motivated as much by a political difference as a philosophical one, with Derrida judging Blanchot’s account inadequate for contemporary political concerns. The development of a professional code of ethics should provide an explanation of the professional values and principals that guide a body of persons engaged in an important role in society. Most professions find ethical standards of conduct are necessary to codify acceptable behavior to develop public trust, reliability, and consistency in their performance. The proposed AMS Code of Ethics for Marketing Educators is the first step in developing communication, debate, and hopefully, agreement about the social responsibility of the marekting (...) discipline. It is important to note that the AMS code was not developed to punish wrongdoers but to provide a positive guide to help marketing educators understand how their actions may be viewed by society. Deliberative democracy entails a commitment to deciding political questions on their merits. To that end, people engage in an exchange of reasons in a shared endeavour to arrive at the right answer or the best judgement they can make in the circumstances. Of course, in practice a shared judgement may be impossible to reach. Yet while compromise may seem a natural way of dealing with the disagreement that deliberation leaves unresolved – for example, some deliberative theorists argue that a willingness (...) to compromise manifests respect for the considered views of others, even as we continue to disagree with them – the relationship between deliberation and compromise is not as straightforward as one might think. To explain why, this paper contrasts conflicts of judgement with conflicts of preference, interest and value to show why greater attention needs to be paid to the character of the decision to be made. Responsibility and accountability of CEOs has been a major ethical concern over the past 10 years. Major ethical dilemmas at Enron, Worldcom, AIG, as well as other well-known organizations have been at least partially blamed on CEO malfeasance. Interviews with Ken Lay, CEO of Enron, after his 2006 fraud convictions provides an opportunity to document his perceived role in the demise of Enron. Possibly no other CEO has had as much impact on the scrutiny and legalization of business ethics as (...) Ken Lay. This analysis is timely because of many information sources now available and the recent Supreme Court decisions on Enron conviction appeals. Using Ken Lay as the focal point, a review of literature provides the background for research questions to explore the role of the CEO in developing an ethical corporate culture. (shrink)

On the dominant economic approach to environmental policy, environmental goods are conceptualised as forms of capital that provide services for human well-being. These services are assigned a monetary value to be weighed against the values of other goods and services. David Wiggins has offered a set of arguments against central assumptions about the nature of well-being, practical reason and ethical deliberation that underpin this dominant economic approach. In this paper I outline these arguments and consider their implications for understanding ethical (...) demands across generations. _The purpose_ of this study is the reflection on ways of philosophical legitimation for the "Self-made-man" idea in the worldview of the Renaissance and Reformation. _Theoretical basis._ Historical, comparative, and hermeneutic methods became the basis for this. The study is based on the works of Nicholas of Cusa, G. Pico della Mirandola, N. Machiavelli, M. Montaigne, E. Roterodamus, M. Luther, J. Calvin together with modern researchers of this period. _Originality._ The analysis allows us to come to the conclusion that casts (...) doubt on the still widespread belief according to which the emergence of the "Self-made-man" idea is localized by the process of forming the American cultural code and the ideological heritage of Benjamin Franklin. It is highlighted that the formation of this idea is the result of a long process that originated in the ancient world and gains a special impetus in the Renaissance and Reformation. Precisely in the cultural context of the latter, the ancient intention to recognize the individual’s right to self-determination and self-government, which in the depths of Christian theology acquires only a potentially universal character, becomes not only acceptable but also, in the context of Protestantism worldview, the only admissible, in fact, individual’s obligatory life guidelines. _Conclusions._ Humanistic and reformation thoughts quite naturally led to further ideological legitimation of the person’s idea of who is creating oneself. This legitimation was during the complex interaction of numerous factors of culture in the Late Middle Ages, as well as ideas and intentions inherited from Antiquity. Key among them was the gradual formation of a new social order, in essence, indifferent to paternalistic rudiments, together with the ethics of Protestantism corresponding to it. The latter does not only legalize but, de facto, sacralizes the individual’s reorientation from hopes for the synergy of God’s grace and own free will in personal salvation, toward the self-reliance and personal efforts, awareness of personal responsibility for the own fate as key principles of the "Self-made-man" concept. Companies' urge to maximise their profits and their attempts to remain in the highly competitive globalised market gave birth to the TQM concept and have kept it alive. TQM is a comprehensive look which encompasses virtually every aspect of the value chain as well as the human resource and customer satisfaction. Therefore, a great number of companies feel obliged to implement its rules, and procedures. However, the concept is rather complicated and culture-bound, and calls for further research in new settings. (...) The aim of this study is to examine the influences of critical success factors of TQM on customer focus therefore, employees are classified based on their perceptions from critical success factors of total quality management and consequently the level of customer focus is compared between the different classifications. The findings reveal that there is significant difference on the level of the customer focus between the established groups of employees. (shrink)

O'Brien, Roderick Among the treasures at the Congregational Archives of the Sisters of St Joseph of the Sacred Heart in North Sydney is a booklet, a hymnal: a collection of hymns and sacred songs attributed to Fr Julian Tenison Woods.1 The purpose of this short article is to introduce one of those hymns, and provide some information about poetry and songs in Woods's life and mission. I am grateful to the archivist for making this booklet available. Introducing this particular hymn, (...) In this article, it is shown that, following the precedent set in particular by Marinus' "Life of Proclus", Damascius, in his "Life of Isidore", uses biography so as to illustrate philosophical progress through the Neoplatonic scale of virtues. Damascius applies this scale, however, to a wide range of figures belonging to pagan philosophical circles of the fifth century AD: they show different degrees and forms of progress in this scale and thus provide an edificatory panorama of patterns of philosophical perfection. (...) Each level of the scale of virtues is shown to be exemplified in Damascius' biographies. It is suggested that few, in Damascius' opinion, reached the highest levels of virtue and that philosophical decline is intimated in his descriptions of his contemporaries. (shrink)

O'Hagan agrees with Dent that in Rousseau's idea of "amour-propre" we encounter a powerful, coherent model of human psychology, according to which individuals find their own identities by engaging in a network of relationships within a more or less reconstituted social order. He examines five ways in which people strive to attain that goal and five ways in which they characteristically fail. What makes ethical accounts natural law ethical is, I argue, commonly misrepresented in teaching within much of the philosophical academy. Yet those immersed in the field of natural law and ethics rarely give definitions/brief characterisations of what makes ethical accounts natural law ethical. I suggest theoretical reasons for the lack. I argue that bringing natural law into ethics is best understood as leading to theoretically unitary accounts, not simply collections of positions detachable from each other: an overlooked and significant point (...) when defending natural law ethical accounts. My arguments throughout rely on the metaethical/normative ethical distinction, which is relatively little used in the natural law literature. I argue that the distinction helps clarify what is distinctive of natural law ethical accounts in general, especially to the secular contemporary philosophical academy, where appreciation of natural law ethical accounts is commonly appreciably lower than in philosophical contexts with a religious ethos. No net loss approaches to environmental policy claim that policy should maintain aggregate levels of natural capital. Substitutability between natural assets allows losses in some assets to be compensated for by gains in others while maintaining overall levels of natural capital. This paper argues that significant goods that matter to people’s well-being will be lost through a policy of no net loss. The concepts of natural capital and ecosystem services that underpin the no net loss approach to environmental policy cannot (...) capture important dimensions of value that are central to human well-being. Scholars have characterised the trial of the life of pleasure in Philebus 20b-21d as digressive or pejorative. I argue that it is neither: it is a thought experiment containing an important argument, in the form of a reductio, of the hypothesis that a life could be most pleasant without cognition. It proceeds in a series of steps, culminating in the precisely chosen image of the jellyfish. Understanding the intended resonance of this creature, and the sense in which it is deprived, (...) is critical for reconstructing the argument, and yields new insight into Plato’s views on the minimal conditions for pleasure. This piece explicates some chief modes of consciousness in phenomenology in order to show that a very significant challenge of virtuality surfaces both within, as well as outside of, the discipline. This issue is of no small importance today, where the difference between perception and imagination, real and irreal, as well as presence and absence, are all becoming increasingly vague because of new technologies and the intrinsic virtualities involved therein. In this context, the question is: Where does virtuality fit in (...) such a picture? I will argue that phenomenology can start to account for such developments, although much more explicative work will be required in the future. With this in mind, sections two to four will articulate an initial phenomenology of perception, phantasy, and image-consciousness, as found chiefly in works by Husserl and Sartre. Then, section five will question the preceding phenomenological theory through some phenomenological and non-phenomenological thinkers, who all seem to have a concept of virtuality at the heart of their work. Lastly, in the final two sections I will suggest a difference between real and irreal virtualities, and briefly mention some current virtual technologies in order to show that there is a constant and complex interplay between the real, irreal, and the virtual in many of our everyday experiences—an interplay that needs to be investigated much further if we are to make sense of how it is changing how we think and behave. By claiming that “just war is just war,” critics suggest that just war theory both distracts from and sanitizes the horror of modern warfare by dressing it up in the language of moral principles. However, the phrase can also be taken as a reminder of why we need just war theory in the first place. It is precisely because just war is just war, with all that this implies, that we must think so carefully and so judiciously about it. Of (...) course, one could argue that the rump of just war scholarship over the past decade has been characterized by disinterest regarding the material realities of warfare. But is this still the case? This essay examines a series of benchmark books on the ethics of war published over the past year. All three exemplify an effort to grapple with the hard facts of modern violent conflict, and they all skillfully bring diverse traditions of just war thinking into conversation with one another. Prior research shows mixed findings regarding individuals’ belief-revision strategies. The current research is aimed to test (a) whether individuals’ reasoning across abstract vs real-world content shows similarity, and (b) whether individuals’ syllogistic reasoning predicts their belief-revision strategies. Experiment 1, testing 76 participants (50 females), provides evidence for the similarity in reasoning across abstract and real-world content (p.05). Individuals seem to revise the conditional statement in the AC and DA inferences, especially when the content poses a threat. In contrast, individuals prefer (...) to revise the categorical premise in the MT inferences, especially when the content poses a threat. These findings suggest that in the face of inconsistency individuals’ decision about which of their prior beliefs they should revise is influenced by the structure and content of the belief-contravening problem rather than their reasoning ability. Hans‐Georg Gadamer has been criticized by a wide range of feminist scholars who argue that his work neglects feminine aspects of understanding, many of which are essential to sound theorizing about educational contexts. In this essay, Linda O’Neill employs Virginia Woolf’s classic gender analysis both as a foil for Gadamer’s philosophical hermeneutics and as an exemplar of feminist reasoning. Through her striking descriptions of embodied tradition, language, and transcendence, Woolf challenges and enriches Gadamer’s work. Bringing Gadamer into conversation with Woolf (...) offers expanded horizons for philosophers of education who choose to ground their studies of teachers and learners in a feminist epistemology resonant with the rich ambiguity of educational experience. This comparison, O’Neill concludes, suggests that the pluralistic reasoning of feminist inquiry offers engendered, embodied insights absent from Gadamer’s hermeneutics and crucial to what Patti Lather calls “fieldwork in philosophy,” an investigative alternative capable of informing sustainable educational policy, practice, and reform.
